Terms of Service
Effective Date: September 30, 2026 • Published by A 10/10 Company
01 Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you (whether individually or on behalf of an entity) and A 10/10 Company ("Company", "we", "us", or "our"), governing your access to and use of the Colibri operations intelligence platform, waitlist mechanisms, API endpoints, early adopter programs, and associated websites (collectively, the "Service").
By accessing the website, joining our waitlist, submitting operational telemetry or incident descriptions, or applying for our Early Adopter Program, you expressly represent that you have read, understood, and agreed to be bound by these Terms. If you do not agree with all of these Terms, you are prohibited from using the Service.
02 Pre-Release & Early Access Software Nature
Waitlist positions and priority invitations are granted on a phased roll-out basis. The Company reserves the right to modulate queue speeds, cap invite cohorts, or adjust onboarding criteria at its sole discretion to preserve service integrity.
If you participate in our Early Adopter Program, your access is subject to additional mutually agreed early adopter terms, recognizing that software architecture is evolving rapidly.
03 Account Responsibility & Referral Codes
To register for the waitlist or partner program, you must provide accurate, current, and complete corporate email and organizational data. You may not use automated bots, disposable email domains, or unauthorized multi-accounting tactics to artificially inflate waitlist positions.
Referral codes ("tokens") issued by Colibri are intended exclusively for sharing with colleagues, peer engineering leaders, and operations team members. The Company reserves the right to void any referrals obtained through fraudulent or abusive distribution methods.
04 Permitted Use & Restrictions
You agree not to:
- Probe, scan, or test the vulnerability of our application servers, APIs, or database clusters.
- Circumvent or attempt to tamper with waitlist queuing algorithms or referral token validations.
- Reverse engineer, decompile, or extract the source code or proprietary synthesis algorithms of the Colibri command engine.
- Submit unlawful, infringing, libelous, or malicious content into the AI interactive synthesis playgrounds or form inputs.
- Resell, lease, or sub-license priority waitlist access or invitation tokens to any third party.
05 Intellectual Property Rights
All rights, title, and interest in and to the Colibri platform—including its visual design, UI layouts, interactive command palette mechanics, proprietary synthesis schemas, algorithms, brand logos, and trademarks—are the exclusive property of A 10/10 Company and its technology partners (Calm Experts).
Any suggestions, feedback, ideas, or feature requests submitted by waitlist participants or early adopters become the non-exclusive intellectual property of the Company without obligation of royalty or compensation.
06 Disclaimers & Limitation of Liability
"AS IS" AND "AS AVAILABLE" DISCLAIMER
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, A 10/10 COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL A 10/10 COMPANY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.
